All visitors to the Children’s Museum of Franklin agree to adhere to the Children’s Museum of Franklin Code of Conduct and Policies.

PRIVACY POLICY
Scope
This Privacy Policy covers Children's Museum of Franklin’s treatment of personally identifiable information that Children's Museum of Franklin collects when you are on the Children's Museum of Franklin web site ("Site"). If you choose to visit sites of other parties by clicking on the links we provide, this policy does not cover the treatment of personally identifiable information that may be collected by those web sites ("Third-Party Sites").

Information Collection and Use
Children's Museum of Franklin collects personally identifiable information including name, address, email address, phone number, ticket type, and event information when you register for an account or purchase products or services. Children's Museum of Franklin also collects information from your browser including browser type, browser version, browser settings, operating system, pages visited, your IP Address, and Cookies. Children's Museum of Franklin uses the above collected information for general purposes such as allowing you to add products and services to your shopping cart, tailoring the content within the Site to match your interests, and ensuring that the site continues to operate properly with commonly used operating systems and browsers.

Children's Museum of Franklin also uses this information to send you information, offers and other promotional materials from Children's Museum of Franklin and selected third parties. You may opt out of receiving information directly from Children's Museum of Franklin by using the contact information above.

The Children's Museum of Franklin Site has security measures in place to protect the information under our control. We use Transport Layer Security (TLS) technology to protect the security of commerce transactions. We encrypt your personal and financial information as it travels over the Internet. We do not store any credit card information for the protection of our consumers.

Your financial information is used for the sole purpose of processing or refunding the transactions which take place on the Children's Museum of Franklin system. By making a purchase, or engaging in any other kind of activity that uses financial information, you consent to our providing your financial information to third parties including the credit card companies and banking institutions used to process the transaction. We may also share your financial information with applicable Contracted Clients (venues/promoters/team owners/organizations that contract directly with Children's Museum of Franklin for ticketing services), primarily for facilitating "will call" ticket pick up, dispute resolution, refunds, and customer service at the event venue on the date of the event.

Children under the age of 13 are prohibited from submitting personal information to Children's Museum of Franklin. Federal Law prohibits web sites from collecting and/or distributing personal information from children without parental consent. At this time, Children's Museum of Franklin has no effective means to obtain and track parental consent. Therefore, Children's Museum of Franklin must prohibit the submission of personal information from children under the age of 13.

Information Sharing and Disclosure
The act of purchasing a ticket or completing a registration form on Children's Museum of Franklin Site automatically grants Children's Museum of Franklin the right to share your personal information with our Contracted Clients (venues/promoters/team owners/organizations that contract directly with Children's Museum of Franklin for ticketing services) in association with the any event you are purchasing a ticket(s) for. The opportunity to opt-out, or not to consent to our sharing of your personal information with them is not available at this time. Contracted Clients may use your personal information in accordance with their own privacy policies and may consequently use your personal information to contact you and may share your personal information with others. You will need to contact those Contracted Clients to instruct them directly regarding your preferences for the use of your personal information by them. You may contact Children's Museum of Franklin to request the Contracted Client's contact information.

Children's Museum of Franklin does not share, sell or rent any of your information with parties other than Contracted Clients at this time. If Children's Museum of Franklin changes this policy in the future, changes will be posted in the area of the web site on the date they become effective and any information used or collected after that date will be subject to the policy in effect at that time. We recommend that you review this policy each time you purchase a ticket to ensure your knowledge of the current policy.

Cookies
Cookies are small text files that are downloaded to your computer. Cookies cannot damage your computer. Cookies, by themselves, cannot be used to identify you. Unless you've chosen to submit personal information to Children's Museum of Franklin though registration or the purchase of products and/or services, Children's Museum of Franklin cannot identify you. Cookies are used by Children's Museum of Franklin to allow the smooth operation of the Site and to track your activity so that we may tailor the content of the Site to match your interests.

RELEASE & WAIVER OF LIABILITY
In consideration of entering the Children's Museum of Franklin (“CMF”) and being allowed to participate in CMF related activities (the “Activities”), the undersigned person (hereinafter referred to as “I” or “my”) agrees to voluntarily assume all risk, including risk of personal injury -- including death -- or illness, the risk of exposure to communicable diseases including COVID-19, and the risk of lost, stolen, or damaged property, or other loss arising from or related to my entry into CMF and participation in any Activities.  In addition, I agree that CMF and its employees, subcontractors, sponsors, agents, and affiliates (collectively, the “Releasees”) will not be responsible for any present or future claims for any such injury, illness, death, property damage, or other loss, even if caused by any of their negligence or otherwise.  I understand and agree that CMF is released and discharged from all such liability to the fullest extent of the law.

I understand that entry into CMF and participation in the Activities involves certain inherent risks (the “Risks”), including but not limited to serious injury, illness (or death), property damage, or other loss. I understand and acknowledge that the potential Risks from being at CMF and participating in the Activities include but are not limited to the following:

  1. Contact or collision with other people or objects, including but not limited to falling off any structures,

  2. Stolen or damaged property,

  3. Fire,

  4. Lost child,

  5. Dysfunction of equipment, structures, displays, and

  6. Illness from exposure to communicable diseases.


Knowing the Risks, I understand that if I am an adult accompanying a child at CMF, I am responsible for staying in the same room as the child and ensuring the child’s safety at all times.

I knowingly assume all of the Risks and take full responsibility for any and all damages, liabilities, losses, or expenses that I, or someone on my behalf, may incur as a result of my entry to CMF and participation in the Activities.  I agree to indemnify and hold harmless the Releasees for all claims arising out of my presence at CMF and participation in the Activities. I also understand that this document is a contract that eliminates the liability of Releasees.

I understand and agree that this Waiver of Liability is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Massachusetts and agree that if any portion of this Agreement is invalid, the remainder will continue in full force and effect.

PUBLICITY RELEASE & WAIVER
I understand that Children's Museum of Franklin ("CMF") periodically films, photographs, and/or records guests for educational and/or promotional uses, including but not limited to, for posting on the CMF website and social media platforms. I agree to be so filmed, photographed, and/or recorded, as indicated below, OR I agree to take on the responsibility of obtaining a sticker from the Information desk, which I agree to wear as a sign to CMF and their agents not to photograph, film, or record me during my visit.

If I do not obtain and wear such a sticker, in exchange for my opportunity to participate in CMF activities, I grant permission to CMF and its agents and employees the irrevocable and unrestricted right to reproduce, in any manner and medium, any photographs, recordings, and/or video images taken of me for CMF’s purpose of education, publication, promotion, or advertising.  I hereby release CMF and its agents and employees for all claims and liability relating to and/or arising out of the use of said images or video.  Furthermore, I grant permission to use any statement that I may give to CMF or its agents or employees during an interview, with or without my name, for the purpose of education, publication, promotion, or advertising without restriction.  I waive my right to prior review of any use of the material and to any compensation.  I understand and agree that this Publicity Release & Waiver constitutes the entire agreement on the subject and is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Massachusetts.  I further agree that if any portion of this Agreement is invalid, the remainder will continue in full force and effect.

AGREEMENT AS TO REFUND POLICY
Guests of Children's Museum of Franklin (“CMF”) who have purchased tickets in advance and need to cancel their visit are asked to contact CMF as soon as possible to enable staff to release the tickets for other visitors. Refunds will be issued if you contact CMF before the start time of your ticket by emailing meg@childrensmuseumfranklin.org to cancel reservations. Birthday party reservations require a non-refundable deposit of $100. Refunds (minus the deposit) will only be issued if canceled at least 7 days prior to the scheduled party.

In purchasing a ticket to CMF, I attest that I have read, understand, and agree to CMF’s Refund Policy.
